Terms of Service

Welcome to The Fitness Syndicate. By accessing or using our website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.

1. Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 17, you must have parental or guardian consent. By using the Platform, you represent that you meet these requirements.

2. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the security of your account credentials.
• You must promptly notify us of any unauthorized use of your account.
• One account per person. Sharing accounts or login credentials is prohibited.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Memberships and Payments

Membership plans

The Fitness Syndicate offers various membership plans as listed on the Platform. Membership details, pricing, and benefits are subject to change with reasonable notice.

Billing

• Recurring memberships are billed automatically at the start of each billing period via the payment method on file.
• All payments are processed securely by Stripe, Inc. The Fitness Syndicate does not store your full payment credentials.
• You authorize us to charge the payment method on file for all fees associated with your membership.

Cancellation

• You may cancel your membership at any time through your account settings or by contacting us.
• Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period.
• Day passes and one-time purchases are non-refundable.

Failed payments

If a payment fails, we will attempt to notify you via email. Your membership may be suspended if payment is not resolved within a reasonable timeframe. We reserve the right to update your payment information using Stripe’s card updater service for expired cards.

4. Facility Rules and Conduct

• Members must comply with all posted facility rules, gym policies, and staff instructions.
• Abusive, threatening, or disruptive behavior will result in immediate termination of membership without refund.
• Facility access is limited to active members and authorized guests.
• Guest access policies are set by the facility and may require additional fees or registration.

5. Liability Waiver

As a condition of membership, you are required to sign a liability waiver and release of claims. By signing the waiver during registration, you acknowledge and accept the inherent risks associated with physical exercise and use of gym facilities and equipment. The full waiver text is presented during account registration and is available upon request.

6. SMS and Communications

By providing your phone number, you consent to receive SMS messages including:

• One-time verification codes for account authentication
• Account and membership notifications
• Schedule reminders and class updates

Message frequency varies. Message and data rates may apply. Reply STOP to opt out of non-essential messages. For help, reply HELP or contact us at train@thefitnesssyndicate.com.

7. Intellectual Property

All content on the Platform, including text, images, logos, workout programs, and software, is the property of The Fitness Syndicate or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any Platform content without express written permission.

8. User Content

You retain ownership of content you create on the Platform (workout logs, messages, profile information). By using the Platform, you grant us a limited license to store, display, and process your content solely for the purpose of providing the service.

9. Trainer Services

Personal training and fitness programs delivered through the Platform are provided by The Fitness Syndicate’s trainers. While trainers are qualified professionals, the Platform does not provide medical advice. Consult your physician before beginning any exercise program, especially if you have pre-existing health conditions.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FITNESS SYNDICATE AND ALICE DIGITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR FACILITY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA.

13. Indemnification

You agree to indemnify and hold harmless The Fitness Syndicate, ALICE Digital LLC, and their respective officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. For material changes, we will notify you by email or through the Platform.

15. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ada County, Idaho.
